    Italian antitrust authority fines Enel X millions

    In spring 2023, the national antitrust authority AGCM launched an investigation into Enel, Italy’s largest energy provider, over the possible abuse of its dominant market position in EV charging. The regulator has now published the findings: Enel X and its subsidiary engaged in what it calls “margin-squeezing practices” aimed at excluding rival operators. According to the authority, Enel used its extensive reach to block competitors from participating in the market.

    The misconduct dates back to 2022 and 2023. In addition to restricting competition, Enel also “hindered innovation in e-mobility services”, the authority said.

    According to Italian media, the company responded immediately to the outcome. Enel X and Enel X Way Italia acknowledged the AGCM’s decision but rejected its conclusions and announced plans to appeal. They argued the investigation should have considered the early stage of the market’s development and the extraordinary, unforeseen rise in electricity prices during the review period.

    In an official statement, Enel X and Enel X Way Italia said they “remain convinced of the legality of their conduct and confident in their ability to defend their rights before the competent bodies.”
